DRAFT — LEGAL REVIEW REQUIRED — NOT EFFECTIVE
1. Accurate posting and identity
The client must accurately identify the hiring individual or business, authorized representative, billing contact, proposed site, duties, worker count, schedule, equipment, hazards and offered worker rate. No misleading or unlawful posting is permitted. Material changes require disclosure and approval before work or dispatch. Business verification and legal responsibilities require review before activation.
2. Worksite safety, training and treatment
Provide a lawful, safe site, required site-specific training, hazard disclosures and coordinated PPE responsibilities. Do not request unsafe, discriminatory, harassing, unlawful or off-the-clock work. Treat workers respectfully and comply with applicable employment, safety and accommodation laws. Actual legal employer obligations cannot be shifted merely by this draft.
3. Worker pay and service fees
Offer a worker pay rate meeting all applicable minimum-wage requirements. All owed hours and legally required overtime, training, waiting or travel remain payable. Numark’s proposed Service Fees total 30% of worker labor. Client estimates display itemized dollar amounts: retention & quality, dispatch & matching, technology & GPS, compliance & administration, and customer support. As an illustration only, $100.00 worker labor produces $8.00, $7.00, $6.00, $5.00 and $4.00 respectively, for $30.00 Service Fees and $130.00 before travel, tips and any lawful processing fee.
4. Proposed processing fee
Only where legally permissible and subject to provider rules, a proposed processing fee consists of the provider’s actual applicable fee plus one percentage point of the applicable transaction base, not a one-dollar charge or a one-percent increase to the provider rate. The provider, base, rate, fixed fees and any legal restrictions must be disclosed and reviewed before approval. No provider or processing charge is configured in this preview, and no such fee is silently added to the calculator.
5. Mileage approval and prepayment
Proposed mileage uses the driving route from the worker’s location at acceptance to the client’s proposed site, not straight-line distance or continuous personal tracking. The first 15 miles per worker are free. Additional miles are charged at $1.50 per mile to the client. The client must approve the quoted mileage and complete prepayment before dispatch. Routing is not live in this preview; manually entered mileage is an estimate only. Worksite changes require a new travel review and approval.
6. Time adjustments, refunds and tips
Estimated hours may differ from actual legally compensable hours. Review verified time and travel records, disclose adjustments and obtain any required approvals without withholding legally owed worker pay. Refunds, failed payments, overpayments and cancellations require an itemized reconciliation under law and provider rules. A final refund schedule is not established by this draft. Tips go 100% to workers, without platform deductions from tips.
7. Cancellation and disputes
Give prompt notice through verified channels when cancelling or changing a job. Any cancellation charges or refunds must be disclosed in legally reviewed final terms and applied lawfully; none are imposed here. Preserve accurate records and raise billing, service or safety disputes through the future verified process. This draft does not waive statutory remedies or impose mandatory arbitration.
8. Direct hire proposal — counsel review required
The proposed direct-hire arrangement is $500 on hire plus 15% of annualized base salary after 90 consecutive days. This is a proposal only, subject to counsel review of enforceability, applicable placement-fee laws, scope, responsible payer, timing and required disclosures. No charge, restriction on worker mobility or binding obligation is created by this draft. Do not pay or rely on this proposal before final lawful terms are approved.
9. Billing security and draft status
Payment collection must use an approved hosted provider; no raw card number, CVV, bank credential or personal tax identifier is collected here. Payment-method status is metadata, not authorization to charge. Privacy, GPS and platform terms are reviewed separately. This document is not effective, does not dispatch workers and is not signed by entering a name. Legal review and verified server records are required before activation.
