DRAFT — LEGAL REVIEW REQUIRED — NOT EFFECTIVE
1. Purpose and legal classification
This proposed framework concerns hourly work arranged through Numark. Classification, employer responsibilities, eligibility and rights depend on applicable law and the actual working relationship, not this draft’s label. No independent-contractor classification, waiver of employee rights, or completed onboarding is established here. Counsel must review jurisdiction-specific requirements before use.
2. Compensation, overtime and tips
Workers must receive payment for all owed hours, including legally compensable training, waiting, travel and overtime when required by law. A posted estimate is not a cap on legally owed compensation. All tips are paid 100% to the worker, without service-fee deductions from tips. Payment timing and wage notices must comply with applicable law and be disclosed before work.
3. Accurate timekeeping
Record actual arrival, start, breaks, changes and departure. Report missed or incorrect time promptly through a verified process. Numark and clients must not request off-the-clock work or alter records to avoid payment. Workers may dispute time records and preserve their own lawful records. All compensable time is reviewed under applicable law.
4. Travel and location
The proposed travel estimate uses a driving route from the worker’s location at job acceptance to the client’s proposed worksite. The first 15 miles are free under the proposed travel allowance; each additional mile provides $1.00 to the worker. This allowance does not replace legally required mileage reimbursement or compensable travel time. Until routing is available, mileage is only a manual preview. Location collection would be limited to the accepted assignment from acceptance through departure, under separately reviewed GPS consent.
5. Safety, PPE and training
Clients must disclose site hazards, provide required site-specific training and coordinate lawful safety obligations. Required PPE, who provides it and any lawful costs must be disclosed before work. Workers should report hazards and may refuse or stop unsafe work without waiving legal protections. Emergency services, not this platform, handle emergencies. No worker should perform work beyond their lawful qualifications.
6. Worksite or scope changes
Material changes to the site, work, hours, rate or travel require disclosure and documented agreement before proceeding, together with any required training. A client cannot require an undisclosed relocation or hazardous task. Changed time or travel must be reviewed for additional legally owed compensation.
7. Credentials, insurance and tax status
Only credential type, issuer, validity dates and status are collected in this preview. Insurance responsibilities may be assigned only where lawful and cannot transfer non-waivable duties. Coverage requirements and exclusions need counsel review. W9 status is metadata only; no SSN, tax form, raw identity document or insurance document is uploaded here. Secure verified collection is required if later lawful and necessary.
8. Cancellation and screening
A worker should notify the verified scheduling channel as soon as an assignment must be cancelled. Any proposed cancellation process must respect illness, emergencies, protected leave and applicable law; no blanket penalty is created by this draft. Screening requires separate lawful disclosure and authorization, permissible purpose, required notices and applicable dispute/adverse-action procedures. Accepting this worker draft is not screening authorization.
9. Privacy, disputes and draft status
Use of personal and location data is governed by separately reviewed privacy and GPS notices. Workers may raise pay, safety, classification and record disputes without waiving statutory remedies. This draft creates no binding arbitration, release, enforceable restriction or signature. Final terms, contacts, retention periods and dispute procedures require legal review and a verified server-recorded acceptance process.
